Parties Send in Request for Preparation of a QDRO
To start the process, the parties or their attorneys must send an appropriate completed QDRO Checklist, Pleadings such as Judgement of Divorce, filed Complaint, Property Settlement Agreement, copies of account statements and full payment.
Confirmation
Upon receipt of a QDRO request, All Pro QDRO will confirm your request via an email and ask for required documents, information or payment, if necessary. Be advised that All Pro QDRO is a third party neutral, we do not obtain records, documents or engage in Discovery. The parties are responsible for obtaining and providing this information.
Preparation
Once All Pro QDRO is in receipt of all information and full payment, we will prepare the requested QDRO(s) pursuant to the terms of the parties’ Property Settlement Agreement and in compliance with the specific Plan Guidelines.
Forwarding Drafts of QDROs
In most cases, All Pro QDRO will forward draft copies of the QDRO(s) via email to both parties or their attorneys (if represented) for review. If there is disagreement between the parties regarding provision to be included in the QDRO, the parties must work this out between themselves. All Pro QDRO does not represent either party and will not negotiate disputes. We will also send the QDRO(s) to the Plan Administrator of the account to obtain Plan pre-approval of the QDRO prior to the parties filing the QDRO with the Court.
Awaiting Plan Pre-approval
Plans have specific provisions that they require in a QDRO. It is best when possible, to have the Plan review the QDRO to ensure it meets with their specific requirements and that the Plan can accomplish the distribution they are being instructed to perform.
Communication from the Plan
Following their review, the Plan will communicate whether the QDRO is acceptable as written or if revisions are necessary. If revisions are necessary, All Pro QDRO will work with the Plan until an approved QDRO is achieved.
Plan Approved QDRO
Once All Pro QDRO receives a communication from the Plan that the QDRO is acceptable, we will send via email to the parties or their attorneys (if represented) a Court ready, finalized QDRO for execution by the parties and filing with the Court. Our involvement with this process is now complete. All Pro QDRO does not handle or distribute any money.
Finalizing the QDRO Process
Once in receipt of the finalized QDRO, the parties or their attorneys (if represented) are responsible for executing the QDRO, filing it with the Court and returning it to the Plan. All Pro QDRO will provide instructions regarding this procedure but is not involved with accomplishing any of these required tasks. Once the Plan has the executed, Court filed QDRO, the Plan will distribute the money or create the pension account.
